Terms of Use

1.1. Miss AI, operated under the Xeleb Protocol ("we," "our," or "us"), provides an AI-powered lifestyle companion hosted on-chain and accessible via platforms such as Xeleb.io and related dApps (collectively, the "Platform"). These Terms of Use ("Terms") govern your use of the Platform.

1.2. Miss AI provides conversational entertainment, lifestyle suggestions, AI-generated content, AI-based skin scan analysis, and engagement features connected to Web3 tokens. These features are for demonstration, entertainment, and community-building purposes only.

1.3. Miss AI is not a source of financial, medical, or legal advice. You should consult with professionals for any real-world decisions involving health, finance, or law.

2.1. Subject to the limitations herein, you are granted a limited, non-exclusive right to use the Platform for personal and non-commercial purposes in accordance with these Terms.

2.2. You agree that Miss AI is powered by third-party AI and blockchain providers. We are not responsible for downtime, API limitations, or node errors resulting from these dependencies.

• 2.3. You represent and warrant that:

  • You are at least 16 years old.
  • Your use of the Platform complies with all applicable laws.
  • You are not on any restricted list (e.g., OFAC, UN Sanctions).
  • You will not use the Platform to generate or distribute unlawful, harmful, or exploitative content.

• 2.4. You may not:

  • Commercialise or redistribute the Platform or its output.
  • Reverse engineer or scrape data.
  • Present yourself as affiliated with Miss AI or Xeleb without written consent.
  • Use bots or automation to exploit reward systems.

3.1. The Platform may include a feature that analyzes skin-related data using AI-powered computer vision algorithms ("Skin Scan").

3.2. The Skin Scan generates AI-based skin metrics, such as estimated levels of redness, acne, pigmentation, oiliness, or hydration based on uploaded or real-time images. These outputs are provided for informational and entertainment purposes only.

3.3. Skin Scan results do not constitute medical advice, diagnosis, or treatment. Always consult a licensed physician or qualified healthcare provider before making decisions related to skincare or medical conditions.

• 3.4. By using this feature, you confirm that:

  • The images provided are lawfully obtained and you have full rights to use them.
  • You understand and agree that the analysis is AI-generated and may not be accurate or clinically validated.
  • You will not use the results to make health claims or guide treatments without professional input.

4.1. You may be required to connect a Web3 wallet (e.g., BEP-20) to use specific features. You are fully responsible for the security and access to your wallet.

4.2. Miss AI does not store your wallet credentials or hold custody of your tokens.

5.1. All content, branding, token models, and AI responses generated by Miss AI are protected under intellectual property rights owned by Xeleb or its licensors.

5.2. You retain ownership of your inputs, but grant us a license to use, store, and display such content to support interaction, personalization, or community rewards.

5.3. We reserve the right to aggregate and anonymize usage data for analytics and service improvements.

6.1. Engagement with the $MSAI token, NFTs, or any reward system is voluntary and subject to the rules set by smart contracts deployed on supported blockchains (e.g., BNB Chain).

6.2. We do not guarantee token value, staking returns, or listing on third-party platforms.

6.3. The use of tokens is at your own risk. Always DYOR (do your own research).

7.1. The Platform is provided "as is" and "as available." We disclaim all express or implied warranties including merchantability, fitness for a particular purpose, and accuracy.

• 7.2. We do not guarantee:

  • Uptime or uninterrupted access.
  • That interactions with Miss AI will be error-free or always appropriate.
  • That smart contracts are immune to exploits or bugs.

• 8.1. To the maximum extent permitted by law, we shall not be liable for:

  • Loss of profit, data, or business opportunity.
  • Token price changes or liquidity issues.
  • Actions taken based on AI responses.
  • Any damages resulting from your use of the Platform.

9.1. You agree to indemnify and hold harmless Miss AI, Xeleb, and affiliated partners from any claim, demand, or loss arising from your breach of these Terms or misuse of the Platform.

10.1. Data Collection and Use: We collect personal data (e.g., name, email, wallet info) and usage data (e.g., interactions, device info) to provide and improve Miss AI’s features. If you use the Skin Scan feature, we collect images for AI analysis. All data is used for service improvement, personalization, and research.

10.2. Data Sharing: We may share your data with trusted third-party service providers and disclose it to comply with legal requirements or in the event of a business transfer.

10.3. Your Rights: You can access, correct, or delete your data. You may opt-out of promotional communications at any time. We use cookies to enhance your experience, and you can manage cookie preferences through your browser.

10.4. Data Security: We use reasonable measures to protect your data, but no system is 100% secure. We do not guarantee the absolute security of your data.

10.5. International Transfers: Your data may be transferred and stored in countries with different data protection laws. By using the platform, you consent to this transfer.

10.6. Children's Privacy: Miss AI is not intended for users under 16. We do not knowingly collect personal data from children.

10.7. Changes to Privacy Policy: We may update this Privacy Policy. Continued use of Miss AI after changes constitutes acceptance of the updated policy.

11.1. We may revise these Terms at any time. Changes will be effective immediately upon posting, unless stated otherwise. Continued use of the Platform implies acceptance.

12.1. These Terms are governed by the laws of the jurisdiction under which the Xeleb Foundation operates. All disputes shall be resolved in competent courts of that jurisdiction.
